Default consumer rights, where do stand with 02 - my phone constantly needs repaired, no replacement yet?

my sony Ericsson keeps breaking basically, the touch screen buttons regularly stop working and do their own thing. at first it was sent away to be"repaired" but still some other problems with it were not - i was told the woman hadnt stated in the repair sheet that they needed fixed too, also she took down my name wrong, and then i was told it would be in the shop, so i went down, but it wasnt... so i wasnt to happy with the service that time. now its back the buttons have broken again so where do i stand because their service is appalling and i think is houdl eb entitled to a new phone, same model, beacause twice its been sent for repair and this hasnt worked.do i have any rights on the matter? my dad seems to think i should be entitled to a new one because it isnt of satisfactory quality and my contract means that i should be able to use the phone! not have to loose it for 3 weeks at a time for repairs. 02 simplicity? i think not :(whats your views and are their any laws

As long as they are willing to repair the phone, they are acting in good faith.

You have rights - Sale Of Goods Act - not fit for the purpose it was designed for - un-merchantable quality. You do not need it repaired again - you have been more than accomodating with the initial repairs and they haven't done it.NEW PHONE in 7 Days - don't ask them TELL THEM.If via a shop - NEW PHONE NOW PLEASEReport it to local Trading Standards Offices at the local council offices/website - they will act on your behalf
